If you are going to disturb or excavate any land in NSW that is likely to contain archaeological relics you will need to apply for approval.

Approval is required if plan to disturb or excavate any land in NSW that is likely to contain archaeological relics.
You must apply and get approval before commencing excavation. Retrospective permits will not be issued.
For items listed on the State Heritage Register, a section 60 approval is required. This approval may be referred to as a section 60 'permit' if it only involves archaeology.

Excavation Permits are granted under section 141 of the Heritage Act 1977.
